General terms of use

1. Purpose

These terms govern access to and use of the cobalt-app.com website and of all services and products offered under the Cobalt brand.

By creating an account, you accept these terms without reservation.

2. Nature of the services — please read carefully

Cobalt designs tools based on artificial intelligence, each specialised in one field.

You must understand and accept the following:

• The content produced by our AIs is generated automatically. It is not written, reviewed or validated by a human before being shown to you.
• Our AIs can be wrong. They may produce inaccurate, incomplete, outdated or unsuitable information.
• Our AIs are in no way a substitute for a qualified professional. They provide no medical, legal, financial or other regulated professional advice.
• You remain solely responsible for the decisions you make and for how you use the generated content.

When in doubt, consult a professional qualified in the relevant field.

3. Access to the service — minimum age

Access to Cobalt services is reserved for people aged 16 or over.

This limit is not a formality. Our tools may produce quantified, personalised recommendations that are not suitable for people who are still growing or developing.

Date of birth is requested at sign-up. Any registration by a person under 16 is refused. An account created on the basis of inaccurate age information may be deleted without notice.

4. User account

• Creating an account requires accurate and up-to-date information.
• You are responsible for the confidentiality of your credentials and for all activity carried out from your account.
• An account is strictly personal. It may not be shared, lent, resold or transferred.
• Notify us without delay at contact@cobalt-app.com in the event of unauthorised use of your account.

5. Financial terms

Cobalt products are currently available free of charge, as part of a limited-time launch offer. No payment is requested and no banking data is collected.

Cobalt reserves the right to change its pricing terms. Any change will be announced in advance and will not apply retroactively to access already obtained.

When sales begin, this section will be replaced by separate Terms of Sale (price incl. tax, payment terms, express waiver of the right of withdrawal collected via a checkbox, legal guarantee of conformity, consumer complaints and mediation).

6. Acceptable use

You agree not to:

• use the services for illegal or fraudulent purposes;
• attempt to bypass technical protections, access third-party accounts or disrupt the operation of the service;
• mass-extract or automate use of the services (scraping, bots, bulk requests);
• resell, redistribute or commercially exploit the generated content without authorisation;
• transmit unlawful, hateful, defamatory content or content that infringes the rights of others.

In the event of a breach, your access may be suspended or removed.

7. Service availability

We strive to ensure continuity of service, without any guarantee of permanent availability. The service may be interrupted for maintenance, updates, or because of a technical provider's failure.

Our services rely on third-party artificial intelligence providers. Unavailability on their part may result in unavailability of our AIs.

8. Intellectual property

Cobalt remains the owner of its trademarks, interfaces, editorial content and source code. The content you generate while using our services is intended for you and may be used for personal purposes.

9. Liability

To the extent permitted by law, Cobalt cannot be held liable for indirect damage resulting from use of the services, nor for the consequences of decisions made on the basis of content generated by our AIs.

Mandatory legal provisions protecting consumers remain applicable.

10. Personal data

The processing of your personal data is described in our Privacy Policy.

11. Changes to the terms

These terms may be modified. Any substantial change will be brought to your attention. Continued use of the service constitutes acceptance.

12. Governing law

French law. In the event of a dispute, an amicable solution will be sought first, by writing to us at contact@cobalt-app.com.

Cobalt Coach — AI-assisted sports and nutrition coaching

Cobalt Coach is not a medical device. It provides no medical advice, diagnosis or treatment.

C.1 — Health warning — essential reading

Cobalt Coach automatically generates training programmes, loads, volumes and quantified nutritional recommendations (calorie intake, macronutrient distribution). These are produced by an artificial intelligence from the information you provide. They may be inaccurate or unsuited to your situation.

Before starting any training programme or changing your diet, consult a doctor. This is particularly important if you are affected by one of the following:

• a cardiac, respiratory, metabolic or joint condition;
• a current or recent injury;
• pregnancy or the post-partum period;
• a history of eating disorders;
• ongoing medical treatment;
• resuming activity after a long period of inactivity.

C.2 — Nutritional recommendations

The calorie intakes and dietary recommendations produced by Cobalt Coach are general estimates, calculated from standard formulas. They do not take into account your actual health, any conditions, allergies, intolerances or treatments.

Never follow a nutritional recommendation that seems excessive, restrictive or unusual to you. When in doubt, consult a doctor or dietitian.

If you are affected by an eating disorder, or if you have concerns about this, we encourage you to speak to a healthcare professional.

C.3 — Safety during exercise

Stop any session immediately in the event of pain, dizziness, abnormal shortness of breath, chest pain or discomfort. In an emergency, call your local emergency number.

The loads and volumes proposed must be adapted to how you feel. Progressing too quickly exposes you to a risk of injury. Listen to your body before the programme.

C.4 — Your responsibility

By using Cobalt Coach, you acknowledge that you:

• practise physical activity entirely at your own risk;
• have checked with a healthcare professional, if necessary, that your condition allows you to exercise;
• understand that Cobalt cannot be held responsible for injuries or health problems resulting from use of the generated programmes.

C.5 — Age

Access to Cobalt Coach is reserved for people aged 16 or over, in accordance with article 3 of these terms.
